State fines maker of children's drink for using misleading advertising

Syracuse, N.Y.—Abbott Laboratories misled consumers by creating the impression that consuming Pediasure Sidekicks drinks makes children more active and successful in sports, according to state Attorney General Eric T. Schneiderman. His office announced today it has reached a settlement with Abbott, which has agreed to stop its advertising for the product and pay a $25,000 penalty to the state.

The misleading advertising involved Pediasure Sidekicks and Sidekicks Clear, sugary drinks with added vitamins and minerals. The Attorney General’s Consumer Frauds Bureau found the company’s “You Are What You Eat” ad compaign conveyed the misleading impression that children who drink Sidekicks are more active and energetic than children who do not.
